SF Landlord Reduces Six-Figure Rent Differential Exposure After Fire Displaces Tenant

The Legal Challenge

A San Francisco landlord was sued by a tenant after a fire displaced her from an illegal, unpermitted rental unit.

Following the fire, the City determined that the unit could not be legalized and could only be used as storage space going forward. As a result, the owner could not repair the unit and return it to the tenant.

The tenant filed suit seeking substantial damages. The largest component of the claim was for rent differential damages, the difference between what the tenant had been paying for the rent-controlled unit and the fair market rent for a comparable unit, multiplied by the length of time the tenant would have remained in possession.

In this case, the rent differential was approximately $1,500 per month. Because the tenant was relatively young, projected damages could have reached hundreds of thousands of dollars over time.

Under the San Francisco Rent Ordinance, exposure was even more serious. In many circumstances, the ordinance allows for treble damages and recovery of the tenant’s attorney’s fees, significantly increasing the financial risk to landlords.

The situation was further complicated by insurance issues. The owner had purchased a policy that did not provide coverage for rent differential damages.

Legal Issues Involved

This matter involved complex landlord-tenant litigation under San Francisco’s rent control laws, including:

  • Rent differential damages
  • Potential treble damages under local ordinance
  • Attorney’s fee exposure
  • Insurance coverage disputes
  • Causation issues related to the fire

The case required litigation strategy, damages analysis, and coordination with the insurance carrier.

Jethro S. Busch, a 2025 Northern California Super Lawyer, focuses on complex real estate and landlord litigation matters, including high-exposure disputes involving property damage, contractual obligations, and statutory claims. His role in this matter was to evaluate liability, assess damages risk, and develop a strategy to reduce the client’s financial exposure.

Strategic Approach

During investigation and discovery, evidence emerged suggesting that the fire may have been caused by unauthorized and unpermitted electrical work performed by the tenant, including the addition of electrical outlets.

While causation in fire cases can be heavily disputed, this evidence created meaningful litigation leverage.

The strategy focused on:

  • Challenging the tenant’s damages model
  • Highlighting causation issues related to the fire
  • Limiting exposure under the rent ordinance
  • Pressuring the insurance carrier to contribute to a resolution

The case proceeded to mediation.

Outcome

At mediation, the matter was resolved for substantially less than the tenant had sought in the lawsuit.

In addition, the insurance company agreed to cover approximately half of the settlement amount, despite the initial coverage limitations.

The resolution significantly reduced the landlord’s potential exposure, which could have escalated into the hundreds of thousands of dollars if the case had proceeded to trial with treble damages and attorney’s fees.

Why This Matters for San Francisco Landlords

San Francisco rent-controlled properties carry unique litigation risks. When a unit is unpermitted or later deemed illegal, the financial exposure in a tenant lawsuit can be severe, particularly when rent differential damages and statutory multipliers are involved.

Landlords should understand:

  • Insurance policies may not cover all categories of damages
  • Rent differential calculations can quickly compound
  • Local ordinances can dramatically increase exposure
  • Early litigation strategy can materially affect settlement outcomes

Cases involving property damage, illegal units, or rent-controlled tenancies require careful legal analysis and strategic positioning.

If you are facing a tenant claim involving rent differential damages, property damage, or complex rent ordinance issues, it is critical to understand your exposure and your options.
